Abstract
The tradition of Islamic legal thought recognizes not only a legacy of usul al-fiqh (Islamic legal theories) also presented its twin, i.e. al-qawaid al-fiqhiyah (Islamic legacy maxims). While the role of the former is well known in deducing the law from its sources, the role of the later in legal reasoning is not widely known. This article attemps to locate preliminary historical background of the emergence of this discipline in the history of Islamic thought and the debates arround its strategic position in the dynamics of Islmic law from the point of view of dialectical development of science.
